0. Definitions

0.1 “Us”, “We”, “The Merchant” refers to M. Ch. Laiki Agora Exartimaton Ltd,

0.2 “You”, “your”, “buyer”,”customer”, “user” refers to the consumer purchasing from this website or the person browsing the website.

0.3 “Website”, “this site”, “the Eshop” refers to samuraicy.com

0.4 “Goods”, “items”, “products” refers to items offered for sale on this website

0.5 “Conditions”, “T&C” refers to this set of terms and conditions.

0.6 “Order” refers to Goods you pledge to buy after going through the online checkout process.

1. Introduction

1.1 The website www.samuraicy.com is an online shop, which was created and is operated under M.Ch. Laiki Agora Exartimaton Ltd, located in Limassol, Misiaouli & Kavazoglou 80, reached by phone on 25561111 or by e-mail on samuraicyprus@gmail.com.

1.2 The Conditions will be applied to the use of the online shop which is found following the electronic address www.samuraicy.com. Each user that has access and makes a purchase through the online shop and the services provided by it, is considered to have agreed and accepted fully the following terms and conditions, with no exception. Should a user not agree with these conditions then he/she oughts with his/her own responsibility to refrain from visiting, using, shopping and making any transactions on the website. The user agrees and complies with these Terms & Conditions by checking the appropriate box on the checkout process.

1.3 Working Hours are Monday to Saturday 0800 – 1300 and Monday, Tuesday, Thursday and Friday 1500 – 1800.

2.0. Contract Formation

2.1 By ordering from Us You are deemed as entering into a contract with M. Ch. Laiki Agora Exartimaton Ltd. As part of this process You will be given the opportunity to check the contents of Your Order and correct any mistakes. Once Your Order has been dispatched any mistakes cannot be rectified. Upon completion of Your Order, you will receive a unique Order number, We recommend keeping this number safe and use it as a reference when talking with Us. Your Order number will be sent by email after the transaction process is completed.

2.2 All Goods are subject to availability. We will notify You as soon as possible should the occasion arises of Us running out of stock of products You have purchased.

2.3 Your Order can be denied if:

– Payment is unauthorised or unsuccessful.

– Items become unavailable.

– You do not meet the eligibility criteria set out in these Conditions.

– There are reasonable grounds for refusing an Order.

2.4 Should You purchase from Our E-Shop, Our Company’s name will appear on your bank statement account. This will be arranged by JCC.

3.0. Pricing & Delivery

3.1 Prices advertised in the Eshop are in Euro and inclusive of VAT (19%). You are responsible for ensuring that all credit and debit card details are correct and that You are using the card in good faith. Some products are only available for pick-up.

3.2 Delivery of items is only available in the Republic of Cyprus. We try our best to dispatch Goods on the next working day from receiving your Order.

3.3 There are two ways to obtain Your Order. You may choose to pick the Order from Our Store, in which case no delivery charges will be applicable. Alternatively, you may choose the delivery option, where you will be charged according to the total weight or size of the order. Goods will be sent with collaboration of ACS Courier. ACS Courier will deliver to where You have specified unless Your address is outside the ACS Courier default delivery radius. In that case, You will be notified to collect Your items from the corresponding collection point nearest to the declared address. ACS Courier will notify You for the delivery service.

3.4 Delivery times are issued in good faith and are not legally binding. We estimate that deliveries will be done as soon as We dispatch them, but a wait of up to 5 days is acceptable. We will not be responsible for any inconvenience arising through delay or loss caused by delivery. If in the rare occasion delivery is late beyond reasonable time (7 days), You should contact Us immediately. We will do Our best to resolve the matter.

3.5 Delivery charges are set out in the Delivery Services section of this site and are shown in the checkout process. You are responsible to declare a correct valid address for the products to be delivered, We bear no responsibility if You fail to do so.

3.6 You will be required to provide a signature upon delivery of Your Order. Once Your Order has been delivered to You, it becomes Your property. We are not responsible for any loss, damage or misuse of Your items once they have been delivered to You. On receival Your items, You must check against the products delivered. You must inform Us of any missing/broken items within 24 hours. After this time no liability will be assumed by Us. You can call Us at 25561111 or email Us on samuraicyprus@gmail.com

3.7 Goods must be used for the purpose for which they are intended and in good faith. Each item contains how-to-use instructions and safety information on its label. We will not be responsible for any injury or damage caused by the misuse of Goods. If You are unsure on how to use an item, please contact us during Our business hours. We recommend to store each product as specified by its own label.

3.8 If Goods are damaged or faulty You must inform Us within 3 working days after delivery. Damage or faults after this time will be deemed as Your responsibility. No warranty is provided unless specified in the item’s description. All goods are checked before dispatch.

3.9 We have the right to alter prices at any point. You will pay the amount specified at the time of the checkout process. Prices exclude delivery charges.

3.10 Force Majeure:

We will not be responsible for any failure to deliver goods, or any delay in delivering goods to you in case this was due to circumstances beyond our reasonable control.

4.0 Cancellations & Returns

4.1 Orders can only be cancelled before the goods have been dispatched. You will need to call US immediately and inform us to cancel the order. If We are closed for the time being, send us an email which We will be checking before any dispatch. We will not deliver the products, then proceed to speak with the Bank to refund your money. We bear no responsibility for any refund delays caused by the bank.

4.2 For items that are considered chemicals, oils, lubricants or additives, returns are not available. This is because there is no guarantee the customer has not used the item, making it unsalable. We do this to ensure each Customer receives proper quantity and quality of each item. If You wish to return Goods that do not belong in the aforementioned categories, you must notify us within 14 days, stating the reason why You wish to return the items.

4.3 You are free to return Goods for a refund or exchange if they are unused and in their sealed state and are suitable for resale and within 14 days of receipt. You will be refunded for the price of the Goods only. Return postage costs will be met by You. Refunds and exchanges will only be authorised once these conditions have been met and we have received the Goods. Good to be returned are Your responsibility until they are received by Us.

We promise to ensure consistent professionalism when it comes to serving Our Customers. All items are inspected and checked before dispatching them to the Customer.

5.0 Website

5.1 We have the right to modify or update freely the terms and conditions of using and transacting through the online shop, whenever deemed necessary. However, the company takes the responsibility of notifying the users of any modifications through the online shop’s pages. 5.2 Copying, reproduction and defamation of the site as a whole or partially is strictly prohibited.

5.3 You are allowed to download images and items’ descriptions for personal use only. Should you wish to use part of the website You must be given permission by an authorised person. Without permission, use of contents of this site is strictly prohibited.

5.4 We target for this website to be available for 24/7. We are not liable for any unavailability e.g. maintenance etc. We will notify in the website for any upcoming updates/changes in the newsfeed. The same applies should We need to suspend the website.

5.5 We reserve the right to exclude individuals who deform or mistreat this website including any of the contents, imagery including logo and text, or who post or transmit offensive material and/or imagery via this website.

5.6 All rights are reserved.

6.0 Miscellaneous

6.1 We will not be liable for any loss or damage caused by using or downloading this site.

6.2 We will not be liable or responsible for any damage or loss caused by visiting third party sites that may be linked to this site. We are not responsible for the content of third party sites.

6.4 Information that You post or publish to or via this website is considered non-confidential unless otherwise stated by You. We may post and/or advertise any such material without prior notice.

6.5 We may change images and content without any prior notice.

6.6 Information on this site is added in good faith, We will not be liable or responsible for any loss or damage caused by this information.

6.7 We may change and/or update these Conditions at any time and without notice. Please check these Conditions regularly for any changes, although We will do Our best to keep everyone informed throughout the newsfeed.

6.8 Some items are only available to be picked-up from Our store. This is because We need to be sure we are providing the correct item for each Customer.

7.0 Faulty Items

For Electrical Items:

7.1 If a fault was developed within 30 days of purchase, You must contact Us as soon as you have found out. We will write down about the incident and give it a reference number. You will need to return the faulty items for a check (You will bear delivery expenses). After check and confirmation that the products are indeed faulty and not because of the customer, We will arrange repair. If repair is not possible, we will arrange a replacement of equal or higher value.

7.2 We have no responsibility for faulty items that happen to occur after 30 days, unless the product comes with a warranty from the manufacturer. If a faulty item has a warranty, the same procedure applies as stated in section 11.2, valid as long as the warranty is valid. If the fault is through misuse by the Customer, the warranty does not apply.

For Non-electrical items:

7.3 If a non-electrical product develops fault within 30 days, please notify Us as soon as You can during our business hours. Items must be returned and inspected from Us to determine if the product is indeed faulty or it was caused from the Customer’s misuse. Should the product prove faulty, an equivalent exchange of the same product will take place.

7.4 We bear no responsibility if faults occur after 30 days of the items’ purchase. Remember that Items must be used fairly and for the purpose for which they are intended. No warranty is provided for non-electrical items.

8.0 Privacy Policy

Comments

8.1 When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

8.2 An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

8.3 If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
